Helping you obtain probate

We understand that obtaining probate happens under stressful and difficult circumstances. Going through all the paperwork is probably the last thing you want to be doing, which is why you may wish to handover the work to a solicitor. By doing this you can be sure that nothing has been missed, which could cause delays in your application.

If there's more than one executor then up to four people can apply jointly. However it's perfectly normal for one person to apply for probate.

Making a will

It's never too early to start making a will. In fact the earlier you do it the better. Whilst you don't have to make a will by law, it's the only way to be sure that your property and possessions will be distributed as you wish after you die.

We recommend seeking legal advice when drafting a will since there are a lot of legal formalities for you to go through. If you've already got a will then you may need to update it if you've not done so lately or if you've recently had a major change in your life such as getting married, divorced or having children.

Applying for lasting power of attorney

A lasting power of attorney is a legal document which assigns a person or persons to make decisions on your behalf. It will take effect if you lack the mental capacity to make important decisions such as planning your health or financial affairs.

To create a lasting power of attorney you will need to apply and then register the application with the Office of the Public Guardian, which can take up to 9 weeks. The application will be refused if it is not completed correctly. We can help ensure that everything is in order and that it is the best possible decision for you.
